If Tirath Singh Rawat becoming the Chief Minister was shocking, then the reason for his departure is even more shocking. Yes, it is a matter of Raj that Tirath Rawat will have to leave the chief minister’s post because he will not be able to get a seat in the assembly. Meaning that he will be able to become an MLA, its hope is negligible. In fact, under the Representation of the People Act, 1951, elections have to be held within six months of any Lok Sabha or Rajya Sabha seat becoming vacant. Accordingly, elections on eight vacant seats in Uttar Pradesh and Uttarakhand will have to be held by September. Under this, if there is one year left for the term of a member of the Lok Sabha or the Legislative Assembly, then an exception can be held.
Now here, the screw has got stuck in the path of Uttarakhand Chief Minister Tirath Singh Rawat becoming an MLA. Because elections are to be held in February 2022 in both UP and Uttarakhand. Also, Uttarakhand Legislative Assembly is to be constituted in March 2022. There is a regular practice or rule of the Election Commission that when the elections are to be held in the state within a year, then by-elections are not held there. Obviously, elections cannot be held in Uttarakhand on this basis. It is not only about Uttarakhand. In other states including Uttar Pradesh, 25 assembly seats are vacant. Not only this, elections are also to be held on three parliamentary and four Rajya Sabha seats.
According to sources, the Election Commission has decided not to hold elections in all 25, including six seats in UP and two in Uttarakhand, due to the corona epidemic after examining all the rules and keeping in view the system. Elections to the assembly seats of other states have been extended. There will be by-elections sooner than later, but by-elections will not be held in eight seats of Uttar Pradesh and Uttarakhand, which are ready to go to the polls.
In such a situation, there will be no way other than the farewell of Tirath Singh Rawat. By the way, during this epidemic in Uttarakhand, there were no two MLAs due to death. Because of this two seats are vacant. Similarly, in Uttar Pradesh too, five out of six MLAs had died of corona. Now after this decision of the Election Commission, it is almost decided that since Tirath will not be a member of any house, he will have to go. Since there is no Legislative Council in Uttarakhand, there is no option to go there too.
Now it is a matter of secret that if Tirath leaves, who will take over the command of Devbhoomi in his place? The answer cannot be decided in a party like BJP. But there is every possibility that someone from Delhi can be sent to Uttarakhand. Two names in this episode are Union Education Minister Ramesh and former Chief Minister of the state Ramesh Pokhriyal Nishank and BJP’s media in-charge and Rajya Sabha MP Anil Baluni.
The Union Cabinet expansion of the second term of the Modi government can happen anytime. PM has done his homework regarding this. It is believed that if Nishank is freed from here, he can be sent to take charge of the hill state. On the other hand, Anil Baluni has the blessings of PM Modi and Home Minister Amit Shah. Due to illness in between, he avoided going among the public. But now being healthy, he is not only constantly going to Uttarakhand, but is also taking full interest.
Baluni’s health was not very good when the first political crisis in Uttarakhand brought about a change. But the way he is active now, the possibility of giving command to Baluni by bidding farewell to Tirath to deal with this constitutional crisis cannot be ruled out. Now it remains to be seen whether Nishank’s experience overshadows or Baluni’s honest image.
