New Delhi: The petitioners seeking a stay on the Central Vista project got a setback from the Supreme Court today. The court refused to change the order of the Delhi High Court imposing a damages of Rs 1 lakh on both. The High Court had imposed the damages by questioning the intention of the petitioners. Today the Supreme Court also said that the petitioners cited Corona. But did not demand a ban on all construction projects. His demand was for only one project. In such a situation, the High Court’s comment on his intention was correct.
Anya Malhotra and Sohail Hashmi said that continuing the work could pose a serious threat to the health of the workers working in the project. Rejecting this petition, on 31 May, the Delhi High Court had said that the workers involved in the construction work are living at the same place. The part of Central Vista which is currently under construction needs to be completed by November this year so that the Republic Day event can be organized without any hindrance.
High Court Justices DN Patel and Jyoti Singh had said that the Central Vista is a project of national importance. People are very interested in this. The Supreme Court has also approved it. Construction work is going on at many places in Delhi. But the petitioners did not talk about them. Only demanded a ban on this project of national importance. His intentions cannot be said to be unambiguous. With this remark, the judges imposed a damages of Rs 1 lakh on both of them.
Both appealed against it in the Supreme Court. Senior advocate Siddharth Luthra, appearing for him, argued that the High Court’s decision is discouraging people who think in public interest. The petitioners did not seek a permanent stay on the project. Only wanted to postpone the work for some time. The Supreme Court bench of Justices AM Khanwilkar, Dinesh Maheshwari and Aniruddha Bose listened to the Luthras for a long time. But he was not convinced. He said that the petitioners did not do any research on the ongoing construction work in Delhi. He filed a petition for the purpose of stopping only one construction. Therefore, there is no need to interfere with the order of the High Court.
