New Delhi: The Delhi High Court on Thursday gave the Twitter company two weeks to file an affidavit in the US to comply with the new IT rules. At the same time, the High Court made it clear that it is not providing any kind of protection against the rule to the microblogging site. The High Court said that the central government is free to take action against Twitter in case of any violation of the new IT rules.
A bench of Justice Rekha Palli fixed the matter for further hearing on July 28, saying, “It is made clear that the court has not passed any interim order. The court has given time to file the affidavit, no security has been given.” has not been provided. Center can take action against respondent no. 2 for any violation of the rules.”
Senior advocate Sajan, appearing for Twitter, told the court that even Twitter is not seeking any protection. “The consequence of non-compliance with the rules is that the security of the arbitrators is lost. I am not seeking any protection,” he said.
Appointment of interim nodal officer within two weeks
The High Court had on July 6 asked Twitter to inform it by July 8 as to when it would appoint an Indian Grievance Officer as per the new IT rules. Poovayya told the court that as per its direction, a note has been filed clarifying the status of the interim Chief Compliance Officer (COO), the interim Grievance Officer (RGO) resident in India as well as the appointment of a nodal liaison officer on an interim basis. is.
He said that while an interim COO has already been appointed on July 6, an interim RGO would be appointed by July 11 and an interim nodal officer within two weeks. Poovayya said Twitter is “actively recruiting for permanent positions.”
“Since Twitter is setting up a liaison office in India, it has not been able to recruit permanent employees,” he said. But he said that mere being interim does not remove the obligation to comply with the rules. He also said that without the liaison office, the issue of tax could have arisen if a permanent employee was appointed. Additional Advocate General Chetan Sharma, appearing for the Centre, objected to Twitter not giving any affidavit or confirmation.
